Russia Overrules ECHR

The Constitutional Court of Russia has overruled the decision of the European Court of Human Rights about granting voting rights to prisoners and declared it unenforceable in Russia. We wrote about this case here.

The court concluded that the ECHR's decision asking Russia to give inmates the right to vote is contrary to the Russian Constitution. The court in Strasbourg cannot demand to change Russia's supreme law.

"By ratifying the Convention for the Protection of Human Rights and Fundamental Freedoms Russia did not consent to amend the Constitution," stated the judges. "The Convention has greater legal force than federal laws but not greater than or equal to the Constitution."

In December 2015, the Russian parliament passed the law that gave the Constitutional Court the right to overrule decisions of international courts.
